8i Networks agrees to provide the paying customer with services according to the Terms Of Service listed below.
The following Terms of Service (herein named TOS) applies to all websites/domains hosted by 8i Networks. The term "applies" is defined as total content of each website/domain, as well as "links" from any website/domain, or to any website/domain.
Content
Transmission, storage, or presentation of any information, data or material in violation of any Canadian or United States Federal, Provincial/State, County, or Municipal/City law is prohibited on all 8i Networks hosting accounts & servers.
- Any material that is Pornographic and sex-related merchandising. This includes sites that may infur sexual content, or links to pornography elsewhere.
- Any material that violates or infringes on the copyright, intellectual property rights or trademark rights of any individual or organization.
- Any software or text that educates, enables or encourages the activity or use of: Piracy, hacking, cracking, phreaking, warez, pyrotechnics, exploitive software.
- Any ROMs and Emulators.
- Any material that is grossly offensive, including , exploitation of children, blatant expressions of bigotry, hatred, harassment, defamation, or invasion of privacy. This includes material that defames, abuses, harasses or threatens any person or group.
- Any form of Spam is not allowed! You may not reference 8i Networks in any unsolicited email that you send.
- You are solely and fully responsible for the contents of your account. Any and all repercussions will be born so lely by you as the account holder.
- Bandwidth, Data Transfer or Traffic
- All hosting accounts come with an alotted amount of monthly bandwidth, data transfer or traffic allowance. Accounts exceeding their bandwidth alottment will first receive an e-mail notifying them of their bandwidth usage and given an opportunity to upgrade their hosting account. If the customer does not upgrade the hosting account, the customer will be billed $2.50/month USD for each 1000 MB of traffic exceeded.
Background Programs & IRC
We do not install or allow any programs required to run through root access on the servers. Most scripts can be run through the users own account and does not require root access. If at any time you are trying to install programs that require root access to any machine then you will need to upgrade to a dedicated server. 8i Networks does not allow IRC or IRC BOTS to be operated on our servers.
Backups
All hosting account holders are responsible for their own backup of data. 8i Networks keeps backups of key server systems only and these backups are not available for customer use. 8i Networks can accept no responsibility for any loss of data or consequences arising from this. 8i Networks always advises clients to back up their site data regularly for their own protection.
Refusal of Service
We reserve the right to refuse, cancel, or suspend service at our sole discretion.
Billing
All prices are in Canadian Dollars
- If a customer does not pay any outstanding invoices within the stated due date on all invoices, their account will be suspended 3 days after the due date on the invoice. (Earliest date for multiple invoices.)
- If a customer does not pay any outstanding invoices within 14 days of the due date on the invoice (Earliest date for multiple non-paid invoices), the hosting account will be terminated and 8i Networks accepts no responsibility for any data loss.
Account Reactivation
If an account has been cancelled, or suspended due to non-payment, you must pay a $35 re-activation fee before the account is re-activated.

30 Day Money Back Guarantee
8i Networks provides a no hassle 30 day money back guarantee. If an 8i Networks hosting account holder is unsatisfied with 8i Networks hosting services, the account holder may request a full refund within 30 days of signup. If a customer violates any 8i Networks Terms of Service or Policy, that customer will not be eligible for any refund regardless of tenure with 8i Networks.
Domain Name Registration Refunds:
All domain registration fees are non-refundable, in whole or in part, even if your domain name registration is suspended, cancelled or transferred prior to the end of your then current registration term.
Uptime Guarantee
In the event that network connectivity for your contracted services is unavailable for more than 0.01% of time in any calendar month, one full day's service credit will be awarded for each hour of downtime beyond the 0.01% threshold. The maximum credit awarded in any calendar month will not exceed 100% of that month's service fees.
Limitation of Liability
In no event will 8i Networks be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use 8i Networks's services or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record.
By signing up with 8i Networks, you agree to all terms stated in this Terms of Services / Policies. If you violate any term listed above, your account will be terminated immediately and no refund partial or whole will be issued. You may incur additional fines of any damages are caused by your violation of these terms.
